Seminar description
This seminar develops a framework for investigating and analysing fundamental social rights (FSR) in the EU, with a special focus on rights at work. It considers first the locations of fundamental social rights in the EU, looking at the specificities of, and relationships between, different locations of FSR protection such as Charters, the Treaties, judicially developed general principles, EU legislation and Council of Europe sources. It considers when and why workers’ rights are treated differently from other fundamental rights in the genesis and development of these sources. It examines the functions of FSRs in the EU – for the EU, its states, its peoples and labour and discrimination law. It investigates how FSRs can be used and enforced in the EU, comparing for example, court-focused mobilisation, agency enforcement and new governance-inspired uses of FSRs.
Course requirements
All participants are required to read the assigned materials and engage in seminar discussions. Each participant will choose a topic within the seminar readings on which to give a short (10-15 minute) presentation in the course of the seminar.
