Seminar description

This short course focuses on recent developments in the application of Article 82 TFEU, Section 2 of the Sherman Act and Section 5 of the Federal Trade Commission Act, placing them in the context of a debate about developing global standards in the regulation of dominant firms. We will compare the EU and US cases with the experience of other jurisdictions before considering more generally the difficulties faced by international groups like the International Competition Network in setting out a shared framework for regulating unilateral conduct, and the struggles of scholars to identify a single test. Topics will include: price squeeze; rebates; abuse of legal process.

 

For each session you will be assigned a set of cases and materials to read and the seminar will be a structured discussion of the materials set. You will be asked to write short reaction commentaries on the readings set as a way of stimulating discussion.
