Complaints and Appeals

The Staff Regulations and the Conditions of Employment of the Teaching Staff offer a number of procedures for dealing with conflicts.

As a first step the staff member should try to resolve the matter by contacting the relevant EUI service to discuss their problem and explain their point of view.

 

Formal Request

(1) If a suitable solution cannot be found, under Article 1(1) of Common Provisions for the Teaching Staff and Administrative Staff the staff member may submit a formal request to the Principal asking him to take a decision.

The Principal will notify the staff member of the decision, which must be reasoned, within four months from the date on which the request was made.

If at the end of that period no reply to the request has been received, this shall be deemed to constitute an implied decision rejecting it. 

 

Formal Complaint

(2) If the request is rejected, the staff member may submit a Complaint to the Principal under Article 1(2) of Common Provisions for the Teaching Staff and Administrative Staff.

The complaint must be lodged within three months from the date of notification of the decision or from the date of expiry of the period prescribed for the reply where the complaint is against an implied decision rejecting a request.

The Principal shall notify the staff member of the decision, which must be reasoned, within four months from the date on which the request was lodged.

If at the end of that period no reply to the complaint has been received, this shall be deemed to constitute an implied decision rejecting it.

Formal Appeal

(3) If the staff member's complaint is rejected, whether expressly or implicitly, they have three months from the date of notification of the reply or the implied rejection, to appeal to the Organ of First Instance within the Appeal Board of the European University Institute.

(4) Within two months of the date of the notification of the First Instance‘s decision, the staff member may submit an appeal to the Appeal Board of the European University Institute.
