Reinforcing Rule of Law Oversight in the European Union?

Since the 1992 Copenhagen criteria, democratic conditionality entered discussions on EU membership and scholarly literature has largely debated conditionality. However, crucially, EU values, including democracy and the rule of law, do not find a detailed reflection in the acquis of the Union, the latter focusing on the areas where the EU is unquestionably competent. In response to this gap, the EU improved its tool-kit to deal with the potential breaches to its basic values via Article 7 of the EU Treaty. This provision, however, remains a purely political, rather than a legal mechanism of enforcement of compliance with EU values. Moreover, it does not provide any guarantees that the situation on the ground in the targeted states would actually improve, following the provision’s deployment. This workshop aims to discuss this issue.
