Democracy and constitutionalism

The course will discuss three accounts of how constitutionalism relates to democracy: the substantive views of constitutions as constraints on democracy of Dworkin and Rawls, the procedural views of constitutions as enabling democracy of Ely and Habermas and the constitutive views of democracy as the basis of constitutionalism of Ackerman, Kramer, and Bellamy.

Fields of law: constitutional law, constitutional theory
