CJC Lecture: Researcher’s Talk: Unwrapping the Black Box: National Courts' Interpretations of Preliminary Rulings
This presentation shows how referring national courts interpret the European Court of Justice’s (ECJ) preliminary rulings in their follow-up judgments in the main proceedings. It assesses assumptions about national courts getting lost in translation after receiving abstract preliminary rulings, policy preferences, and difficulties in aligning EU law with national law. By adopting an empirical approach, it analyzes preliminary reference procedures from order for reference to the national follow-up judgment, hereby in particular focusing on how national courts follow the ECJ’s legal instructions. The study focuses on cases in the Area of Freedom, Security and Justice which are generally considered highly politicized and touching upon the core of Member State’s sovereignty and fundamental rights.
