Judicial behavior and judicial reasoning: The European perspective
This seminar examines the interplay of law and politics in judicial decision making from the legal and from the political science perspective. It focuses on the Court of Justice of the EU.
The seminar will be co-taught by Daniel Naurin, who is a professor of political science in Oslo and Gothenburg.
When courts decide cases, law, politics, and personalities matter. The key question, which the seminar seeks to explore, is how much and when?
Learning outcomes:
- To reflect on the role of context and actors on the form and the content of the legal argument
- To evaluate the power of the Court of Justice to influence political, economic, and social processes
- To identify the interplay between the legal argument and the extra legal factors
- To critically apply pol sci theory to the legal analysis of case law of the Court
