This session will address, from a multidisciplinary perspective, the decision of the Facebook's Oversight Board to ban President Trump from Facebook, discussing the impact of this decision on constitutional law, the public-private divide, global governance, and the role of private adjudication in digital platforms.

On the 5th of May 2021, Facebook's Oversight Board delivered its landmark opinion on President Trump's ban from Facebook. The decision confirmed Facebook's ban but judged against the proportionality of the measure, sending the last word back to Facebook. The decision marks a foundational moment for the Oversight Board, which is now described as a Marbury moment.
