Michal Bobek, judge at the Supreme Administrative Court of the Czech Republic, Professor at Charles University, Prague, and former Advocate General at the Court of Justice of the European Union, will discuss the proposed amendments to the Statute of the Court of Justice of the European Union. The proposal grants jurisdiction to the General Court over preliminary references in some areas of EU law. Bobek will examine whether this is the best solution for a durable new architecture of the European Union judiciary and suggest alternative approaches.
In December 2022, the Court of Justice submitted a request to amend Protocol No 3 on the Statute of the Court of Justice. Among the proposed amendments, the General Court will be granted jurisdiction over preliminary references in areas including value-added tax, excise duties, and greenhouse gas emissions trading. In his presentation "Preliminary Rulings before the General Court: What Judicial Architecture for EU Courts", Michal Bobek will share his views on this proposal, asking whether it reflects the best solution for a durable new judicial architecture before EU courts and posit what could be contemplated instead. Michal Bobek is a judge at the Supreme Administrative Court of the Czech Republic (Brno, Czech Republic) and a Professor at Charles University (Prague, Czech Republic); he was Advocate General at the Court of Justice of the European Union between 2015 and 2021 and is an alumnus of the European University Institute. The event will be in-person only.
