About the event:
On 4 October 2024, the European Court of Justice delivered several important rulings, but one, in particular, caught attention: C-633/22 Real Madrid vs Le Monde.
In this case, the Court ruled that when defamation damages are excessive, they could violate press freedom, potentially triggering the public policy exception under the Brussels I Regulation for recognising and enforcing foreign judgments. This decision opens the door for national courts to conduct a substantive review of foreign judgments, even when the mutual trust principle is in play, to safeguard fundamental rights within the EU. What is additionally interesting, in his opinion for the case Advocate General Maciej Szpunar hinted at a potential connection between the case and the phenomenon that is currently widely discussed in the EU, strategic lawsuits against public participation (SLAPPs).
