Join Elena Faletti and Chiara Gallese as they explore the practice of credit scoring and present their analysis of the guidance provided by the CJEU and national courts on credit scoring and the processing of personal insolvency data by credit reference agencies.
Credit scoring is a widely used practice that assigns a score based on certain characteristics or past behaviour, particularly concerning a debtor’s reliability in repaying loans.
In most cases, this score forms the basis of credit agencies' decisions on whether to approve loan applications. However, grey areas remain—particularly in balancing the transparency owed to consumers regarding the processing of their financial data with the protection of trade secrets held by credit scoring agencies.
Elena Faletti and Chiara Gallese will present their analysis of the guidance provided by the CJEU and national courts on credit scoring, in light of the SCHUFA decision (Cases C-26/22 and C-64/22), which addresses the processing of personal insolvency data by credit reference agencies, with a specific focus on the practices of SCHUFA Holding AG, a major German credit bureau.
They will also offer reflections on the application of Article 22 of the General Data Protection Regulation—which relates to automated individual decision-making, including profiling—taking into account not only the AI Act, but also the most recent developments regarding transparency requirements, such as those indicated in the Dun & Bradstreet Austria case (C-203/22).
