Starting with the seminal judges in the Portuguese judges case, the CJEU has started operationalizing the EU values in the last decade. National judges and the European Commission have then fueled the CJEU with opportunities to develop that case law, for example in the Repubblika case and the infringement cases against Poland: rule of law and democracy have been the values mostly adjudicated in Kirchberg. The pending case C-769/22 Commission v Hungary ( anti-LGBTQ ) relates to the human rights, equality and human dignity as values. For the first time, the European Commission, supported by 16 Member States and the European parliament, is putting forward, besides violations of the EU internal market rules and the Charter of Fundamental Rights, an autonomous plea related Article 2 TEU.
The workshop will take the form of an informal conversation about the role of Union values in the case law and judicial practice, in light also of the Advocate General’s Opinion in that case, scheduled for 5 June 2025. Different viewpoints from the European Commission, civil society, national governments and academia will be presented.
