The digitalization of medicine is advancing rapidly, transforming the delivery of healthcare. Cross-border telemedicine is playing a central role in this development by enhancing the accessibility and efficiency of patient care. However, cross-border telemedicine also raises a number of complex legal questions. In its judgement in Österreichische Zahnärztekammer (C 115/24), the European Court of Justice (CJEU) addressed key aspects of EU secondary legislation governing cross-border telemedicine, with a particular focus on dental services. In his presentation, Sebastian Scholz will analyze the judgment and its implications for the digital health sector, highlighting the questions left open by the CJEU.

Sebastian Scholz is Assistant Professor (Tenure Track) of Technology and Innovation Law at the Department of Public Law and Political Science at the University of Graz. He obtained his habilitation in 2024 at the University of Graz in the fields of public law and European law, with a thesis on 'Steering the Implementation of EU Law through Soft Law'. His research focuses on technology and innovation law, public business law, the relationship between EU law and state law and the effective judicial protection in integrated administration. From February 2014 to August 2017, he gained practical legal experience in the Austrian Parliamentary Administration, the Constitutional Service of the Austrian Federal Chancellery and two leading Austrian law firms.
