The Digital Services Act (Regulation 2022/2065) is a one of the latest rulebooks for regulating online services. It is aimed at rebalancing power between internet users and platforms. Among many things, it distributes power on determining what content moderation processes look like online. How that power is distributed, and to whom it is attributed, determines the scope of freedom of expression on the internet. This entails a delicate balancing act between users, civil society, platforms, state- and suprastate regulators, that requires safeguards on the involvement of each of those actors. In this presentation, Jacob van de Kerkhof addresses some of the concerns that this balancing act causes. Furthermore, private enforcement of the DSA is picking up across member states. National courts are issuing lower- and appeal level decisions on DSA cases. In this sense, this event’s discussion will also revolve around the question of how enforcement is shaping up across the EU, aiming to find points for future collaboration across jurisdictions.
