The European Union Law Working Group and the Constitutional Law and Politics Working Group are pleased to invite you for a discussion on the 2024 Reform of the Statute of the CJEU.
The EU judicial system is undergoing a far-reaching reform process, which constitutes its most significant transformation since the creation of the Court of First Instance in 1989. In September 2024, the new Regulation amending Protocol No. 3 on the Statute of the CJEU entered into force, providing, inter alia, for the transfer of jurisdiction to give preliminary rulings from the Court of Justice to the General Court in six specific fields.
This presentation analyses the structural consequences that the 2024 reform entails for the EU judicial system, identifies its shortcomings, and assesses its impact on the respective roles of the Court of Justice and the General Court. In particular, it examines several procedural amendments introduced by the 2024 reform that contribute to strengthening the constitutional role of the Court of Justice.
As the 2024 reform probably represents only the first step in a fundamental reimagination of the EU’s judicial architecture, the presentation reflects on potential future developments of the EU judicial system. It underscores the need for a clear demarcation of responsibilities between the Court of Justice and the General Court and the articulation of a long-term vision for the respective roles of these two courts. The General Court has the potential to develop into an increasingly important first-instance court for direct and indirect actions, while the Court of Justice could gain greater breathing space to focus on cases raising constitutional questions.
