The regulation of national enforcement and the proliferation of EU direct enforcement, i.e. vis-à-vis private actors, have been used to address enforcement shortcomings. This, in turn, leads to the more fundamental questions on the function and the content of the (EU) law. What should be regulated in the EU law exactly to ensure its goals and legal certainty? What is a 'good' law or 'better' regulation? And how may we use all the knowledge gathered on enforcement to improve the law? The presentation is based on Professor Scholten’s paper 'Let us wait and see first how the law does not work? ‘Better Regulation’ can do better!'.SpeakerProfessor Miroslava (Mira) Scholten is an Associate Professor of EU law enforcement, a member of the Utrecht Centre for Regulation and Enforcement in Europe (RENFORCE) and the director of the LLM Law and Economics. Since 2019, she coordinates the Jean Monnet Network on EU Law Enforcement (EULEN), an initiative of 9 European Universities, funded by the EU Commission (2019-2023), and is the creator and co-editor of eulawenforcement.com.
