Rebel Treaties: strategies to overcome great powers’ unwillingness to confront planetary threats and catastrophes –from climate change to outer space exploration, to war & AI and beyond.

The Summer School explores ‘rebellious treaty making’ in international law, namely the negotiation of new hard law rules offering an answer to a concrete planetary threat or catastrophe, most of the time, by directly prohibiting the harmful conduct. When do states engage in rebellious treaty making’? Is this a strategy followed by smaller states, NGOs or coalitions formed by states and non-state actors? Are actors who have been specially affected by global problems driving rebel-treaty negotiations? Should rebellious treaty-making strategies be understood as symbolic and performative, or as tactics to achieve change in international law? We will study existing rebel treaties proscribing cluster bombs, nuclear weapons; current negotiations to pass rebel treaties banning plastic, fossil fuels; and potential rebel treaties enabling peace negotiations, and prohibiting for-profit space exploration, geoengineering or military AI.
