On 13 July 2022, The General Court of the European Union confirmed the European Commission’s jurisdiction to review the Illumina/Grail transaction after a referral pursuant to Article 22 EUMR. The judgment endorses the EC’s recent change in its art. 22 referral policy, which regulates the situations in which member states can refer cases that do not meet national thresholds to the EU. The General Court’s judgment may embolden the EC to call in for review certain transactions even where merger control thresholds are not fulfilled. This could concern suspected 'killer-acquisitions.'
